Subject: Complaint Regarding the Actions of the Public Prosecution Service Zeeland-West Brabant and Fivoor

Dear Ms. Agema, Mr. Van Weel, and Mr. Struycken,

I hereby file a formal complaint regarding the handling of my reports and personal situation by the Public Prosecution Service (OM) Zeeland-West Brabant and Fivoor, a provider of forensic and intensive psychiatric care. As a citizen who has been dealing with digital stalking, identity misuse, cybercrime, and administrative failures since 2020, I am deeply concerned about systemic deficiencies and the lack of legal protection. This situation has profoundly undermined my trust in the rule of law.

Inaccurate and Deficient Reporting by Fivoor

Since early 2024, I have been subjected to coercive measures by Fivoor based on reports from a Dutch psychologist and a Belgian psychiatrist, dated March–April 2023 and spring 2024. While my interactions with the psychiatrist were positive, the spring 2024 report is substantively inadequate. It lacks any analysis of the long-term effects of digital stalking and cybercrime, which are central to my case.

Another report from spring 2023, prepared by a freelance pro-justitia psychologist from the Tilburg network, is even more seriously flawed. I filed a complaint about this report with the Netherlands Institute for Forensic Psychiatry and Psychology (NIFP). The NIFP’s response was unsatisfactory: I was invited to a meeting with their lawyer, which I found intimidating and dismissive. Fivoor continues to rely on reports that misrepresent my situation and ignores my repeated clarifications that I am neither a perpetrator nor a victim, but a citizen caught in a dysfunctional administrative and legal system.

Negligence by the Public Prosecution Service Zeeland-West Brabant

The Public Prosecution Service has never thoroughly investigated my 2020 report of stalking, cybercrime, and administrative misconduct. Instead, I was wrongly labeled a threat to local authorities, after which I was referred to Fivoor. This reflects a shocking lack of diligence and a tendency to look the other way, which obscures the actual issues and marginalizes me as a whistleblower.

Despite my repeated attempts to be heard, these serious issues have remained unaddressed and unresolved for nearly five years.

Systemic Shortcomings and Lack of Oversight

Both Fivoor and the Public Prosecution Service operate under the supervision of the Custodial Institutions Agency (DJI) and the Ministry of Justice and Security, respectively. Their handling of my case reveals systemic shortcomings, including:

  • Lack of expertise regarding digital stalking and cybercrime,
  • Blind reliance on flawed reports, and
  • The absence of accessible and independent complaint mechanisms.

The NIFP’s dismissive response to my complaint exemplifies the broader lack of accountability and restorative thinking within this system.

Requests

I request that you:

  1. Conduct an investigation into the actions of the Public Prosecution Service Zeeland-West Brabant and the motives and justification for my referral to Fivoor.
  2. Commission an independent investigation into the substantive accuracy and professional diligence of:
    • The report by the Belgian psychiatrist (spring 2024), and
    • The report by the freelance psychologist from the Tilburg network (spring 2023).
  3. Ensure that citizens reporting administrative failures and digital insecurity are not placed in psychiatric programs without evidence or recourse.
  4. Strengthen oversight of forensic psychiatry and complaint procedures at the NIFP.
  5. Consider the European Convention on Human Rights (ECHR, Article 8: right to respect for private life and data protection), as well as the GDPR and the Dutch Constitution (Articles 10 and 11), when evaluating my case.

Context and Additional Steps

This complaint does not stand alone. In connection with my reports, I have:

  • Requested the Council of State to establish a Levelt Cyber Council in Tilburg to oversee digital security and administrative culture.
  • Contacted Member of Parliament Esmah Lahlah to request parliamentary questions about this situation.
  • Made multiple attempts to bring my case to the attention of independent bodies, including the Netherlands Institute for Human Rights and the National Ombudsman.

Additional Medical Context

I would like to emphasize that, on my own initiative, I underwent an intensive cognitive behavioral therapy program with a reputable and certified clinical psychologist within the regular mental healthcare system between June 2022 and October 2023. During this one-and-a-half-year treatment, three interim psychological evaluations were conducted. All three evaluations confirmed a diagnosis related to trauma and post-traumatic stress disorder (PTSD). These diagnostic findings stand in stark contrast to the superficial and divergent interpretations presented by Fivoor. The final report, including the three substantiated interim results, is included in my general practitioner’s file and is available for review upon request.
